Purchase Policy

Bloom Digital Media Ltd (“Bloom”, “our,” “we,” or “us”) offers certain enhanced features of the Services which we offer for purchase as a monthly subscription fee and daily fee to be determined by the spending made by you from the sub-account, based on the commission rates to be determined by the spending thresholds (“Purchase”). A description of features associated with any of our Purchases are available via our Services. When you purchase a Purchase (each, a “Transaction”), we may request from you to supply additional information relevant to your Transaction, such as your banking account number, banking details, credit card number, the expiration date of your credit card, tax number, cryptocurrency wallet or similar technologies used account, name-surname and your address(es) for the purpose of billing and delivery (such information, “Payment Information”). We do not store or process any Payment Information. Each Transaction and Payment Information is tokenised by our fully licensed third-party payment service providers to ensure the highest standards of payment security. You represent and warrant that you have the legal right to use all payment method(s) represented by any such Payment Information. The amounts due and payable by you for a Transaction through the Services will be presented to you before you place your order and as long as you continue to receive service, unless you cancel this acceptance process that you made at the beginning of the service, your approval under this article will be deemed to exist. If you choose to initiate a Transaction via the Services, you authorise us to transfer your Payment Information to our third party service providers so we can complete your Transaction and agree

(a) to pay the applicable fees and any taxes;

(b) that Bloom via our partner payment service providers may charge your credit card or third-party payment processing account, including, but not limited to, your account with distribution platform, for verification, pre-authorisation and payment purposes;

(c) to bear any additional charges that your provider, bank or other financial service provider may levy on you as well as any taxes or fees that may apply to your order. Your order is not binding on Bloom until accepted and confirmed by Bloom. All payments made are non-refundable and non-transferable except as expressly provided in these Terms.

The parties accept that the monthly price and daily commission rate announced in a public and accessible manner on this website are an integral part of the Policy.

Bloom shall have a right to set-off, adjust or appropriate any other payments due to / from your account. Further, in case of any overdue from the you, Bloom shall have the right to suspend or terminate the Services.

Bloom will request the payment for Service’s before activating the Customer’s use of Service. In Bloom ’s sole discretion, any delay by the Customer to settle an invoice by the due date may subject the Customer to an additional fee at the rate of 1.5% per month on the overdue amount.

If you have any concerns or objections regarding charges, you agree to raise them with us first and you agree not to cancel or reject any credit card or third party payment processing charges unless you have made a reasonable attempt at resolving the matter directly with Bloom.

Bloom reserves the right to not process or to cancel your order in certain circumstances, for example, if your credit card is declined, if we suspect the request or order is fraudulent, or in other circumstances Bloom deems appropriate in its sole discretion. Bloom also reserves the right, in its sole discretion, to take steps to verify your identity in connection with your order. You may need to provide additional information to verify your identity before completing your Transaction (such information is included within the definition of Payment Information). Bloom will either not charge you or refund the charges for orders that we do not process or cancel. If Bloom is unable to collect the relevant amount over the Payment Information from the payment method defined by you in any of the Purchase it offers, other Purchase will be canceled in addition to the uncollectible package.

Transactions will be made with payment instruments permitted by Bloom, such as EFT, Swift, cryptocurrency and credit cards. The Partner is solely responsible for all kinds costs and expenses such as commissions, service fees arising from the transactions carried out with its Payment Instruments.

Purchases Automatically Renew Until You Cancel & How to Cancel Your Purchase

All amounts are payable and charged: (i) for daily commission determined by your spending, at the time you place your order; and (ii) for monthly subscriptions, and, because each such subscription renews automatically for an additional period equal in length to the expiring subscription term until you cancel it, at the time of each renewal until you cancel, using the Payment Information you have provided. If you do not make any ads spending from the account, you do not oblige to pay any daily commission fee. You must cancel your monthly subscription before it renews to avoid the billing of the fees for the next subscription period. You can cancel the Purchase at any time by contacting us by email at adssupport@bloomdigitmedia.com

You will not receive a refund for the fees you already paid for your current Purchase period and you will continue to receive the Services ordered until the end of your current Purchase period.

Changes to Purchases

Bloom reserves the right to change its pricing terms for Purchases at any time and Bloom will notify you in advance of such changes becoming effective. Changes to the pricing terms will not apply retroactively and will only apply for Purchase renewals after such changed pricing terms have been communicated to you. If you do not agree with the changes to our pricing terms then you may choose not to renew your Purchase in accordance with our most up to date Terms of Service.

Future Functionality

You agree that your purchases are not contingent on the performance of any future functionality or features, or dependent on any marketing or notifications related to future functionality or features.

Cryptocurrency Transactions and Definitions

You declare to have all necessary rights to use our Services and chosen payment methods, according to the jurisdiction or the country of which you are a citizen or resident. You acknowledge, agree and understand that it is your sole responsibility to not choose and use specific payment methods at all if you are forbidden, restricted, not suitable by regulation, jurisdiction or any other reason. You agree and have full responsibility for, and indemnify and save and hold harmless Bloom and its associates from any adverse action by You.

1. Definitions:

Cryptocurrency : A digital or virtual form of currency that uses cryptography for security and operates independently of a central authority or traditional banking system.

Blockchain : A decentralized digital ledger that records cryptocurrency transactions across multiple computers to ensure the security and integrity of the records.

2. Accepted Cryptocurrencies : Bloom accepts payments in specific cryptocurrencies. The accepted cryptocurrencies can change at Bloom’s discretion and will be specified during the payment process.

3. Transaction Confirmations : A cryptocurrency transaction will be considered complete once it has received the necessary network confirmations on its respective blockchain. You are responsible for any miner fees or network fees associated with your transaction.

4. Country Restrictions : Cryptocurrency payments are NOT available to users from countries where cryptocurrency is not recognized as a legal form of payment. By using cryptocurrency as a payment method, you confirm that you are not violating any local regulations or restrictions. You accept all responsibilities and liabilities for any regulatory or legal issues that might arise from your use of cryptocurrency on Bloom.

5. Refunds : All payments made are non-refundable and non-transferable except as expressly provided in these Terms. In the event of a refund, the amount to be returned will be determined by Bloom based on the USD value of the transaction at the time of the original payment. All transaction fees, miner fees, and any other associated costs will be borne by you. Refunds will be processed in the same cryptocurrency used for the original transaction unless otherwise specified by Bloom or if legally requested through a court decision.

6. No Chargebacks and Disclaimers : Cryptocurrency transactions are irreversible. Once confirmed, they cannot be reversed or charged back. You acknowledge this risk and agree not to hold Bloom liable for any disputes related to cryptocurrency transactions. Additionally, you understand that cryptocurrency values can be highly volatile and that Bloom is not responsible for any financial loss or gain from such fluctuations.

7. Liabilities : You accept all responsibilities and liabilities related to cryptocurrency transactions. Bloom will not be held responsible for any loss, damage, or inconvenience caused by factors outside of its control, including but not limited to cryptocurrency market volatility, network delays, or regulatory changes.
